ARTICLE 1 – PURPOSE
The purpose of this notice is to define the terms and conditions under which the Publisher provides Internet users with the www.bubbletree.fr website (the “Site”) and the conditions under which Internet users access and use this Site. Any connection to the Site is subject to full acceptance of and compliance with the present legal notice, which the Publisher reserves the right to modify or update at any time.
ARTICLE 2 – ACCESS TO THE SITE
In principle, access to the Site is possible 24 hours a day, 7 days a week, except in cases of force majeure and subject to maintenance operations necessary for the proper functioning of the Site and the underlying hardware, or to possible breakdowns. Access to the Site is via the Internet user’s computer equipment connected to a telecommunications network providing access to the Internet. The communication protocols used are those in use on the Internet. The right to access and use the Site is non-exclusive and non-transferable.
Internet users are solely responsible for the suitability of the equipment they use and the conditions of their access, in order to benefit optimally from the services offered by the Site. In this respect, it is expressly reminded that any Internet access from a public terminal requires special handling and verification on the part of the Internet user to ensure the confidentiality of his consultation and the absence of automatic recordings likely to reveal confidential data to third parties. The publisher declines all responsibility for the conditions under which the Internet user connects to the Site.
The mandatory legislation of certain states or autonomous regions may limit, regulate or even prohibit access to the Site. The Internet user must therefore ensure, before connecting to the Site, that such connection does not contravene the regulations applicable to the geographical area from which he/she is connecting. The Publisher shall not be held liable in this respect.
ARTICLE 3 – INTELLECTUAL PROPERTY RIGHTS
The entire content of the Site, including all data, information, images, illustrations, logos, trademarks, graphic charters, tree structures, etc., is protected under all relevant intellectual property rights (in particular copyright, design rights and trademark rights). Any copy, reproduction, representation, adaptation or distribution, in whole or in part, of any element of the Site, by any process whatsoever, is strictly prohibited without the prior written consent of the Publisher.
Any violation of the aforementioned prohibition shall constitute an infringement of copyright (as provided for in article L. 335-2 of the French Intellectual Property Code), without prejudice to any liability (civil or criminal) of the perpetrator for unfair competition and parasitism.
The elements presented on the Site are subject to change without notice and are made available without any guarantee of any kind, either express or tacit; as such, they cannot give rise to any right to compensation.
ARTICLE 4 – HYPERTEXT LINKS
In any event, all links from sites that are contrary to public decency, violent, pornographic or paedophilic in nature, that may offend human dignity or that are intended to display or sell prohibited or illicit objects, substances and/or works are strictly prohibited.
4.1 Hypertext links to the Site
Under no circumstances shall the existence of a hypertext link from a third-party site to the Site in itself imply the existence of any cooperation between the Publisher and that third-party site. The Editor has no control over the content of third-party sites and therefore assumes no responsibility for the content, products, services, information, materials or software of sites that may contain a hypertext link to the Site.
4.2 Hypertext links to third-party sites
The Site may contain links to the sites of the Publisher’s partners or to third-party sites.
The Publisher has no control over these sites and consequently assumes no responsibility for the availability of these sites, their content, advertising or the products and/or services available on or from these sites. The Publisher shall in no way be liable for any direct or indirect damage that may arise from the Internet user’s access to the partner and/or third-party site and from the Internet user’s use of the content and services of this site.
ARTICLE 5 – LIMITATION OF LIABILITY
The data and information published on the Site are provided without any express or tacit guarantee of any kind whatsoever; consequently, the Publisher will not incur any civil liability as a result of the information published on its Site. Accordingly, the Site may be modified at any time without notice.
The Publisher accepts no liability whatsoever (whether direct, indirect, principal or incidental) for any loss or damage suffered by an Internet user as a result of the total or partial loss of, or damage to, any programs, data or equipment when accessing or using the Site (or any other site referenced on the Site). It is the sole responsibility of Internet users to take all appropriate measures to protect their own hardware, programs and data from contamination by any form of virus circulating on the Internet.
ARTICLE 6 – JURISDICTION AND APPLICABLE LAW
Any dispute arising in connection with the Site shall be brought exclusively before the courts of Strasbourg and shall be governed by and construed in accordance with French law. Use of the Site implies the user’s express agreement to the application of the present jurisdictional clause.
If any provision of this legal notice is held to be illegal, invalid or unenforceable for any reason whatsoever, it shall be deemed not to form part of this legal notice and shall not affect the legality, validity and enforceability of the remaining provisions hereof.
ARTICLE 7 – DATA PROTECTION AND FREEDOM
In accordance with Law No. 78-17 of January 6, 1978 (known as the Data Protection Act), the Site is subject to a declaration to the French National Commission for Information Technology and Civil Liberties under reference.
